Italian Citizenship by Descent – Jure Sanguinis

Under Italian law, a person having an Italian ancestor (for example a parent, grandparent, great-grandparent, great-great grandparent – there are no limits on generations) may be eligible to apply for Italian citizenship. Also, a person married to an Italian citizen may acquire Italian citizenship through marriage.

Citizens of other countries who are descendants of an Italian-born person and who meet specific criteria, can acquire Italian citizenship and become Italian citizens.

Italian citizenship can be obtained through the paternal or the maternal line.

To this end, the oldest Italian ancestor from whom you can claim Italian citizenship must have been still alive on or after March 17, 1861, when Italy became a Unified Nation.

People born to parents who have the right to claim Italian citizenship Jure Sanguinis can obtain Italian citizenship if certain conditions are met. This means that if one of your ancestors was Italian – even dating back as far as the nineteenth century – you may be eligible to become an Italian citizen without renouncing your own citizenship.

The 1948 Rule

The 1948 Rule allows descendants of an ancestor born to an Italian woman before 1948 to claim Italian citizenship before the Italian courts.

This Rule enables the acquisition of Italian citizenship jure sanguinis through the female line of ancestry even when your Italian female ancestor (grandmother, great-grandmother, etc.) gave birth before 1948, in contrast with Law no. 555/1912 – which did not allow that.

The Italian Constitution, which came into force on January 1st, 1948, provides for equal rights between men and women. Therefore, in 1983, the Italian Constitutional Court ruled that the impossibility for women to transmit Italian citizenship by blood was unconstitutional. In those cases, claimants are required to take their cases directly to the Italian courts.

Italian Citizenship by Marriage – Jure Matrimonii

If you marry or are married to an Italian citizen, you can acquire Italian citizenship too.

In particular, if you live outside Italy, you must wait three years after the date of the marriage to an Italian citizen, or 18 months if you have children.

If you are married to an Italian citizen and you live in Italy, you can apply for citizenship two years after the date of the marriage to an Italian citizen or just one year if you have children.

Also, to obtain Italian citizenship through marriage, you must prove to have sufficient knowledge of the Italian language through a B1-level certification from an authorized institution, and submit criminal records.

Furthermore, you should register with A.I.R.E. (if you do not reside in Italy) or register your foreign marriage or civil union with a local Italian consulate, as well as register your marriage or civil union with the Italian municipality.
